Monthly Membership – $20 per Child
This Membership Agreement and Payment Authorization (this “Agreement”) governs the membership program (the “Membership Program”) offered by Down to Play LLC (“Down to Play”). I, the undersigned, agree to the terms of this Agreement on behalf of each enrolled child and acknowledge the requirements set forth herein.

1. Membership Benefits
Each enrolled child will receive the following benefits:
  1. One free entry per month, valid any day (weekends, weekdays, or holidays). This free entry must be used within the calendar month it is issued and does not roll over.
  2. One free snack (up to $2 value) per visit.
  3. Special member pricing on additional visits — $15 on weekdays (excluding holidays) and $17 on weekends & holidays.
  4. Discounted 10-pack of Open Play passes for $150 (normally $170).
  5. Birthday party perk: If an enrolled child hosts a birthday party, each attending child receives either a free snack (up to $2 value) or a free pair of socks (subject to availability).
2. Membership Overview
  1. A “Membership” refers to enrollment of one (1) child in the Membership Program. Each Membership:
  2. is child-specific and cannot be transferred, shared, or used by any child other than the one to whom it is assigned;
  3. has no cash value and is not redeemable for cash unless required by law; and
  4. may not be offered for resale.

Each Membership must be maintained individually. Memberships may be purchased by another adult (such as a grandparent or relative) on behalf of a child; however, a parent or guardian must have a signed Liability Waiver on file for each enrolled child before that child may access membership benefits.

Membership benefits are subject to change with 30 days’ written notice. Access to membership benefits is subject to facility capacity and availability. Down to Play does not guarantee admission at a specific time or day.

2. Children Covered by this Membership Agreement
I agree to purchase a Membership for each child listed below for a membership fee of $20.00 per month plus applicable taxes.

I confirm that a parent or guardian of each child listed has completed or will complete a signed Assumption of Risk, Release and Waiver of Liability and Indemnity Agreement (“Liability Waiver”) before that child may access membership benefits.

4. Payment Authorization
By signing below, I authorize Down to Play to charge my credit or debit card (the “Payment Method”) for the membership fee per enrolled child, plus applicable taxes, on the first day of each month, beginning with the next billing cycle. I further authorize Down to Play to store my Payment Method information for future use consistent with this authorization. Note: Payment information is not collected through this form. Payment details are collected securely through Down to Play’s payment processor during your next visit. Payment credentials are stored securely by the processor and are not retained on-site by Down to Play.

Charges recur monthly until canceled. Payments may be processed on the next business day if the 1st falls on a weekend or holiday. I am responsible for keeping my payment information current. I acknowledge that Down to Play may obtain updated information regarding any Payment Method I provide from my financial institution, and that any such updates may be used for future charges. If multiple Payment Methods are on file, Down to Play may charge any such Payment Method.

5. Cancellation Policy
  1. When you can cancel: Memberships may be canceled anytime after the first month of membership.
  2. How and when to cancel: Provide written notice at least three (3) days prior to the end of the month to avoid charges for the following month. Cancellations must be submitted via email to contact@downtoplay.com.
  3. Per-child basis: Each child’s Membership is canceled independently; canceling one child’s Membership does not automatically cancel any other Membership.
  4. Benefits through end of month: If a Membership is canceled in the middle of the month, benefits remain active until the last day of that month.
  5. No refunds/proration: No refunds or proration will be issued for partial months, unused time, or missed benefits.

6. Failed Payments
If a payment fails, I understand access to membership benefits may be suspended until payment is resolved.

7. Additional Terms
This Agreement is separate from the required Liability Waiver and does not amend, modify, replace, or supersede it. I agree that I and any child I bring to Down to Play’s facility will follow all posted rules and behavior expectations while on site.

Down to Play reserves the right to suspend or cancel a Membership, including any associated Memberships, without notice or refund, for any reason in its sole discretion, including without limitation: repeated rule violations; unsafe behavior; failure to follow staff instructions; abusive, vulgar, or offensive behavior by a child or their parent/guardian toward any Down to Play staff or other guests; or Down to Play’s belief that continued use would violate this Agreement or applicable law.

This Agreement, the Liability Waiver, and all other documents referenced herein constitute the entire understanding between Down to Play and the undersigned with respect to the Membership Program and supersede all prior or contemporaneous agreements, statements, and representations. Headings are for reference only and do not affect meaning.

8. Governing Law
This Agreement is governed by the laws of the State of Texas. Any disputes arising from this Agreement shall be brought in a court of competent jurisdiction in Dallas County, Texas.

9. Parent/Guardian Information
* Please use the same phone number associated with your signed Liability Waiver. If no waiver is on file, you must complete a waiver using the link provided by Down to Play in addition to submitting this Membership Agreement.
